These Terms of Service ("Terms") constitute a legally binding agreement between you and Forklift Quote King ("Forklift Quote King," "we," "us," or "our") governing your access to and use of the website forkliftquoteking.com (the "Site") and the services we provide (collectively, the "Service"). By accessing the Site or submitting a quote request, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Service.
By accessing or using the Service in any manner, including submitting a quote request or contact form, you represent that you have read, understood, and agree to be bound by these Terms. We may update these Terms from time to time as described below, and your continued use constitutes acceptance of the updated Terms.
Forklift Quote King is a free lead-matching and referral service. We connect users interested in buying or renting forklifts and related material-handling equipment with third-party dealers, sellers, and rental providers ("Dealers"). We are not a forklift dealer, broker, manufacturer, lender, or rental company. We do not own, sell, rent, finance, service, inspect, or deliver any equipment, and we are not a party to any transaction between you and a Dealer.
You must be at least 18 years old and capable of forming a binding contract to use the Service. By using the Service, you represent and warrant that you meet these requirements and that any information you submit is accurate and that you are authorized to submit it.
We work to match you with reputable Dealers, but we make no guarantee that you will receive a quote, that any quote will meet your expectations, that equipment will be available, or that any particular price, term, financing, condition, or outcome will result. All quotes, pricing, availability, specifications, warranties, and representations come solely from the Dealer, not from Forklift Quote King.
You agree to provide accurate, current, and complete information; to use the Service only for lawful business purposes; not to submit requests on behalf of another person or entity without authorization; and to perform your own due diligence — including inspecting equipment and reviewing any contract — before entering into any transaction with a Dealer. You are solely responsible for evaluating any Dealer, equipment, quote, or agreement.
By submitting a quote request and providing your telephone number, you expressly consent to receive telephone calls, text messages, and emails from Forklift Quote King and the Dealers we match you with regarding your request, including through automatic telephone dialing systems, prerecorded or artificial voice messages, and automated text messaging, where permitted by applicable law. Consent is not a condition of any purchase. Message and data rates may apply, and message frequency varies. You may revoke consent and opt out at any time by replying STOP to text messages, following opt-out instructions in emails, or contacting us. This consent is intended to satisfy applicable requirements, including the Telephone Consumer Protection Act (TCPA).
Any purchase, rental, financing, service, inspection, or delivery agreement is strictly between you and the Dealer. Forklift Quote King is not responsible for, and disclaims all liability arising from, the acts, omissions, products, services, pricing, equipment condition, representations, warranties, or conduct of any Dealer. Any dispute regarding equipment, pricing, delivery, condition, financing, or service must be resolved directly with the Dealer.
Forklift Quote King may receive compensation from Dealers — such as referral or lead fees — when we connect you with them or when a transaction results from a referral. This compensation supports our free service and adds no cost to you. See our Disclaimer for additional detail.
You agree not to: use the Service for any unlawful, fraudulent, or unauthorized purpose; submit false, misleading, or another person's information without authorization; interfere with or disrupt the Service or its servers; attempt to gain unauthorized access to any portion of the Service; use any automated means to scrape, harvest, or collect data from the Site; or use the Service to transmit any malware, spam, or harmful code. We reserve the right to refuse service, remove content, or restrict access at our discretion.
All content on the Site — including text, graphics, logos, the crown mark and brand name, page design, and the selection and arrangement of all content — is owned by or licensed to Forklift Quote King and is protected by copyright, trademark, and other intellectual-property laws. You may not copy, reproduce, republish, distribute, modify, or create derivative works from our content without our prior written permission. Brand and manufacturer names referenced on the Site are the property of their respective owners and are used for identification purposes only.
The Service may contain links to, or content from, third-party websites and resources that we do not control. We provide these for convenience only and do not endorse and are not responsible for the content, products, services, or practices of any third party. Your use of third-party sites is at your own risk and subject to their terms.
THE SERVICE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, ACCURACY, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, timely, secure, or error-free, or that any information provided is accurate, complete, or current. Any reliance on the Service or its content is at your own risk.
TO THE FULLEST EXTENT PERMITTED BY LAW, FORKLIFT QUOTE KING AND ITS OWNERS, OFFICERS, EMPLOYEES, AGENTS, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE, YOUR DEALINGS WITH ANY DEALER, OR ANY EQUIPMENT TRANSACTION, WHETHER BASED IN CONTRACT, TORT, OR ANY OTHER THEORY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100).
You agree to indemnify, defend, and hold harmless Forklift Quote King and its owners, officers, employees, agents, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to your use of the Service, your violation of these Terms, your violation of any law or the rights of a third party, or your dealings with any Dealer.
Please read this section carefully. Except where prohibited by law, you and Forklift Quote King agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service will be resolved through binding individual arbitration rather than in court, except that either party may bring an individual claim in small-claims court. You and Forklift Quote King waive any right to a jury trial and agree that claims will be brought only in an individual capacity and not as part of any class or representative action. If any portion of this section is found unenforceable, the remainder will continue to apply.
These Terms are governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict-of-law principles. Subject to the arbitration provision above, you agree that any permitted court action will be brought exclusively in the state or federal courts located in Florida, and you consent to their jurisdiction.
If any provision of these Terms is found to be invalid or unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect. Our failure to enforce any right or provision will not be deemed a waiver of that right or provision.
These Terms, together with our Privacy Policy and Disclaimer, constitute the entire agreement between you and Forklift Quote King regarding the Service and supersede any prior agreements or understandings.
We may modify these Terms at any time. When we do, we will revise the "Last updated" date above. Material changes will be effective upon posting, and your continued use of the Service after changes are posted constitutes acceptance of the revised Terms.
